The court may grant an OFP if any of the following exists:
- A party needs to be restrained from committing further acts of abuse
- A party needs to be excluded from a dwelling shared with the victim
- The abuser needs to be kept away from the petitioner’s place of employment
The order is temporary, so a full hearing can be granted on the petition so that permanent order can be granted. The alleged abuser is able to have an evidentiary hearing after having a short initial appearance where he or she denies or admits the allegations. If the abuser admits the allegations, the permanent OFP is put into place.
From there, the petitioner is safe and any minor children. Everything from temporary child custody and temporary spousal support to temporary possession of property can be awarded.
